U.S. SKI & SNOWBOARD GOLD PASS SWEEPSTAKES SWEEPSTAKES OFFICIAL RULES

We, U.S. Ski & Snowboard ("Sponsor", "we" or "us"), located at 1 Victory Lane, Park City, Summit County, State of Utah, 84060, are sponsoring and holding this sweepstake ("Sweepstakes"). By entering the Sweepstakes, you agree to these binding rules ("Official Rules"). We will conduct the Sweepstakes substantially as described in these Official Rules. NO PURCHASE NECESSARY TO ENTER OR WIN. A PAYMENT OR PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. These Sweepstakes are void anywhere where applicable laws prohibit the Sweepstakes.

Eligibility. The Sweepstakes is only open to all legal residents of the 50 United States and the District of Columbia who are at least 18 years of age or older at the time of entry. You are not eligible to be selected as a winner if you do not meet these conditions, if you were directly involved in organizing these Sweepstakes, or if applicable laws prohibit you from entering the Sweepstakes. The following are also not eligible to participate: Representatives, officers, directors, employees, or the immediate family members of such individuals, of U.S. Ski & Snowboard, its affiliates, or any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes.

Drawing and How to Enter. The entry period begins November 29, 2024 at 12:00 am Mountain Standard Time ("MST") and ends April 1, 2025 at 11:59 pm MST ("Entry Period"). The drawing will take place on April 10, 2025 at 11:00 am MST.

To enter the Sweepstakes, go to sweeps-insider.usskiandsnowboard.org and complete the entry form by purchasing one (1) annual 2024-2025 U.S. Ski & Snowboard Pass. You may also enter the Sweepstakes without purchasing one (1) annual 2024-2025 U.S. Ski & Snowboard Pass by completing and submitting the entry at www.usskiandsnowboard.org. Only one entry per person is permitted. If you submit more than one entry during the Entry Period, all of your entries will only count as one entry. All of your entries will be disqualified if: (i) you attempt to use more than one email account to submit entries to the Sweepstakes; or (ii) you attempt to cheat, tamper with the systems used to operate the Sweepstakes, or otherwise interfere with the legitimate operation of the Sweepstakes. If we do not receive your entry for any reason outside of our control, your entry will be disqualified. Proof of submission will not be deemed as proof of receipt by us. We are not responsible for any entry that is lost, late, incomplete, invalid, unintelligible, undeliverable, or misdirected, whether due to technical errors, omissions, or otherwise. By entering the Sweepstakes, you agree to be bound by the terms of these Official Rules, which are final and binding in all matters relating to the Sweepstakes.

One (1) Prize. The following prize is available through the Sweepstakes: one (1) U.S. Ski & Snowboard Gold Pass valued at approximately $2,000 ("Gold Pass"). The approximate retail value of the prize is the amount described above in U.S. Dollars. The U.S. Ski & Snowboard Gold Pass grants the winner with direct-to-lift access to participating ski resorts in the United States. The Gold Pass may be used by only one (1) person per day at participating ski areas. At many ski areas, Gold Pass holders may scan their Gold Pass at the ski lift for direct access to the mountain. At ski areas where direct-to-lift access is not available, Gold Pass holder will be issued a one-day ski lift ticket valid for all ski lifts. Gold Pass holder may obtain one (1) ski lift ticket at only one ski area per day. The issued ski lift ticket is non-refundable and under no circumstances can it be given away, bartered or sold. Misuse of the U.S. Ski & Snowboard Gold Pass will result in the Gold Pass being revoked. The U.S. Ski & Snowboard Gold Pass may be used fifty (50) times per season at each of the participating ski areas. The U.S. Ski & Snowboard Gold Pass is not redeemable for any summer activities available at the participating ski areas. The value of the Gold Pass set forth above represents Sponsor's good faith determination of the approximate retail value thereof, and the actual fair market value, as ultimately determined by Sponsor, is final and binding and cannot be challenged or appealed. In the event the stated approximate retail value of the Gold Pass is more than the actual fair market value of the Gold Pass, the difference will not be awarded in cash or otherwise. Gold Pass is non-transferable and non-exchangeable. No refunds, or alternatives will be offered due to the winner's inability to attend, claim, or use the Gold Pass. The Sponsor is not responsible for lost, stolen or any unused portion of the U.S. Ski & Snowboard Gold Pass. If the advertised prize cannot be awarded due to circumstances beyond Sponsor's reasonable control, a substitute prize of equal or greater value may be awarded in Sponsor's sole discretion. In no event shall the Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules.

Drawing and Winner Notifications. One (1) winner of the Sweepstakes will be randomly selected from all eligible entrants who successfully submitted an entry in accordance with these Official Rules. A member of our Sweepstakes team will notify the potential winner at the email address submitted at the time of entry. There is a limit of one prize per household. To receive the prize, the potential winner must submit all information that we need to provide the prize and comply with applicable laws. Please note that there is no cash alternative for any prize. We are not responsible for any email transmission that fails to deliver through no fault of U.S. Ski & Snowboard. If applicable, we will cover the costs of shipping the prizes to you.

Unless we are satisfied at our sole discretion that the potential winner is eligible to win a prize in accordance with these Official Rules, potential winner must sign and return, within three business days, an Affidavit of Eligibility and IRS W9 Form to claim their prize. No liability is assumed for any potential winner notification that is lost, intercepted or not received by a potential winner for any reason. If (i) a potential winner declines a prize for any reason prior to award; (ii) a potential winner fails to sign and return the Affidavit of Eligibility within three business days of our provision to the potential winner of the Affidavit of Eligibility; or (iii) a potential winner is found to be ineligible or disqualified for any other reason in accordance with these Official Rules, we will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entrants. We will repeat this process until the prize is claimed. Any difference between the stated approximate retail value and actual value of a prize will not be awarded. The winner is solely responsible for any federal, state, and local taxes, if applicable. No substitution of the prize is permitted. Winner will be required to supply Sponsor with his/her social security number. Any winner who receives a prize valued at six hundred dollars ($600) or more will be issued a FORM 1099-MISC for tax purposes as required by law.

To comply with applicable legal requirements, we will publish the surname and location of the winner of the U.S. Ski & Snowboard Gold Pass on our website and notify all entrants of the winners. If you are in certain jurisdictions, you may have the right to object to us publishing your information on our website by contacting us at insider@usskiandsnowboard.org. In such circumstances, we may still be required to provide such information to a government authority on request.

Odds. The odds of winning will depend on the number of eligible entrants who enter the Sweepstakes in accordance with these Official Rules; i.e., one (1) (number of prizes) out of the number of all eligible entrants.

Limitation of Liability. You agree that U.S. Ski & Snowboard and our respective affiliates, suppliers, employees and agents (collectively, the "Released Parties"), shall not be responsible or liable for any losses, damages or injuries of any kind resulting from your participation in the Sweepstakes or any Sweepstakes-related activity, unless occasioned by gross negligence or willful misconduct. To the maximum extent permitted by law, you agree to fully indemnify each Released Party from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any breach by you of these rules or any misrepresentation made by you in connection with the Sweepstakes.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SYSTEM OR SERVICE RELATED TO THESE SWEEPSTAKES, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. WE AND OUR SERVICE PROVIDERS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

WE DO NOT EXCLUDE OR LIMIT IN ANY WAY OUR LIABILITY TO YOU WHERE IT WOULD BE UNLAWFUL TO DO SO. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS, FRAUD OR FRAUDULENT MISREPRESENTATION. WE DO NOT VOLUNTARILY ACCEPT RESPONSIBILITY FOR ANY LOSS OR DAMAGE THAT WAS (A) NOT CAUSED BY OUR BREACH OF THESE OFFICIAL RULES; OR (B) NOT, AT THE TIME WE ENTERED INTO THESE OFFICIAL RULES, A REASONABLY FORESEEABLE CONSEQUENCE OF US BREACHING THESE OFFICIAL RULES. LOSS OR DAMAGE IS FORESEEABLE IF EITHER IT IS OBVIOUS THAT IT WILL HAPPEN OR IF, AT THE TIME THESE OFFICIAL RULES WERE ENTERED INTO, BOTH WE AND YOU KNEW IT MIGHT HAPPEN.

Privacy Notice. We collect any personal information that you submit with your entry into the Sweepstakes, which may include identifiers such as your name and email address, and we use it for the purposes of administering these Sweepstakes, exercising our rights, and discharging our obligations under applicable law. We collect social security number from the winner to administer the Sweepstakes, exercise our rights and discharge our obligations under applicable law. We disclose personal information to our service providers. We will also announce the winner of the Sweepstakes including by publishing the name and location of the winner on our website, and disclose personal information about Sweepstakes entrants and winner to third parties such as regulators where required by applicable law. We retain personal information submitted during the Sweepstakes for as long as necessary to administer the Sweepstakes and any contractual relationship with you, and to comply with applicable laws. Participation in the Sweepstakes is voluntary but we require some personal information from you to enter you into the drawing, deliver your prize to you if you win, and comply with applicable laws.

Uncontrollable Events. In the event the operation or integrity of the Sweepstakes are compromised by an event beyond our reasonable control, we may suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, we may award the prize based on the entries received before the termination date.

Governing Law. This Sweepstakes is governed by the laws of the State of Utah, without regard to its conflict of laws rules.

NAME OF WINNER: To obtain the name of the winner, available after April 30, 2025 or a copy of the Official Rules, send a self-addressed, stamped #10 envelope to be received by May 30, 2025, to: U.S. Ski & Snowboard Gold Pass Sweepstakes P.O. Box 1008, Manhasset, NY 11030. Please specify "Official Rules" or "Winners List". VT residents do not need to affix return postage for Official Rules Requests.
